Privacy Policy

Collection of Personal Information


CanWest Notaries is committed to protecting the privacy and confidentiality of personal information in accordance with the Personal Information Protection Act (“PIPA”). Personal information is defined as “all information about an identifiable individual.”


In order to provide high-quality service, proactively counteract fraud, and comply with B.C. Notary Society regulations, CanWest Notaries may collect and retain personal information from clients. This includes information obtained directly from clients or from third parties, if necessary. By retaining CanWest Notaries for advice or representation, clients consent to the collection, use, or disclosure of their personal information to properly advise and represent them.


Use and Disclosure


Under PIPA, CanWest Notaries may collect, use, or disclose personal information without consent in certain circumstances, including:

  • When it is in the interests of the individual and consent cannot be obtained promptly.
  • When necessary for an investigation or legal proceeding.
  • When information is already publicly available.
  • When disclosure is required by law.


Access and Request for Personal Information


Clients may submit a written request to CanWest Notaries to access their own personal information held by the firm, inquire about third parties to whom their personal information has been provided, and request details about how their personal information has been used. CanWest Notaries will adhere to PIPA timelines (30 days) for responding to such requests and reserves the right to charge fees and disbursements as permitted by law.


Non-Disclosure


Outside the specified circumstances, clients do not necessarily have the right to access personal information under CanWest Notaries' control. PIPA restricts disclosure of personal information if:

  • It could reasonably be expected to threaten the health or safety of a third party.
  • It would reveal personal information about someone else without their consent.
  • It would reveal confidential commercial information harmful to an organization’s competitive position.
  • It pertains to information held by a mediator, arbitrator, or court-appointed entity.


Our Commitment to Privacy Protection


CanWest Notaries pledges to:

  • Make reasonable efforts to ensure collected information is accurate and complete.
  • Correct information that is found to be incorrect or incomplete.
  • Implement appropriate measures to secure electronically stored and paper-based personal information against unauthorized access.
